1. What is MARPOL? Global Scope & Technical Framework

MARPOL stands for the International Convention for the Prevention of Pollution from Ships. Administered by the International Maritime Organization (IMO), it forms the primary regulatory bulwark protecting oceans, coastal waters, and the atmosphere from vessel-generated pollutants.

The original convention was drafted in 1973 and substantially augmented by the 1978 Protocol following high-profile tanker disasters like the Argo Merchant and Amoco Cadiz. Because the 1973 convention had not yet entered into force, the combined treaty became universally known as MARPOL 73/78, formally taking effect on 2 October 1983.

MARPOL applies to all ships flying the flag of a State Party or operating under its authority, encompassing commercial cargo carriers, passenger liners, offshore support vessels, and fixed platforms. While naval vessels have sovereign immunity, Flag Administrations mandate that their fleets conform to MARPOL standards to the fullest extent practicable.

Source Control Mechanism

Unlike civil liability regimes that compensate for damage after a spill, MARPOL prevents environmental release at the source. It imposes strict hardware construction standards (double hulls, segregated ballast tanks, closed loops), operational discharge restrictions, and evidentiary paper trails.

2. The Six Annexes in Order: Architecture & Core Standards

In oral examinations and flag state audits, candidates are routinely asked to recite the six annexes in precise technical sequence. The numbering follows the logical evolution of maritime pollution control, transitioning from bulk hydrocarbons to atmospheric chemistry:

Annex I: Prevention of Pollution by Oil

Controls operational oily waste and accidental spills. Regulates machinery-space bilge discharge (≤15 ppm), sludge handling, fuel bunkering, double-hull tanker architecture, and cargo ballast monitoring.

Statutory Certificate: IOPP (International Oil Pollution Prevention Certificate).

Annex II: Noxious Liquid Substances in Bulk

Controls chemicals carried in tankers, categorised by marine hazard (Category X, Y, Z, and OS). Enforces mandatory tank stripping limits (75 litres), approved prewashes, and underwater discharge.

Statutory Certificate: NLS Certificate / Certificate of Fitness.

Annex III: Harmful Substances in Packaged Form

Regulates maritime freight carried in containers, drums, tanks, and packages. Enforces the mandatory IMDG Code for marking, labelling, packaging integrity, stowage separation, and documentation.

Annex IV: Prevention of Pollution by Sewage

Controls sanitary effluent from heads, urinals, and medical spaces (black water). Mandates certified Sewage Treatment Plants (STPs) or comminuting/disinfecting holding tanks based on distance from land.

Statutory Certificate: ISPP (International Sewage Pollution Prevention Certificate).

Annex V: Prevention of Pollution by Garbage

Establishes an absolute global prohibition on the discharge of all plastics. Restricts other shipboard domestic and operational waste, permitting food waste and non-harmful cargo residues only at specified distances.

Statutory Instrument: Garbage Management Plan & Garbage Record Book.

Annex VI: Prevention of Air Pollution

Controls atmospheric emissions from main propulsion, auxiliaries, and incinerators. Limits fuel sulphur (0.50% global, 0.10% ECA), diesel NOx tiers, ozone-depleting substances, and greenhouse gas efficiency (EEXI/CII).

Statutory Certificate: IAPP (International Air Pollution Prevention Certificate).

Operational discharge criteria depend directly on the ship's geographic position relative to land and water depth. Maritime law defines specific radial thresholds from the nearest baseline:

3. Technical Controls, Effluent Limits & Evidentiary Records

MARPOL enforces its mandates through three interlocking pillars: prescribed shipboard hardware, numerical effluent thresholds, and mandatory official logs. Falsification or failure to maintain these logs constitutes a strict-liability criminal offence in most maritime jurisdictions.

The Special Area Regime:

MARPOL designates Special Areas where oceanographic characteristics, ecological vulnerability, and high vessel traffic demand stringent protections beyond baseline requirements. Within Special Areas, operational discharges permitted in open waters are largely prohibited:

Annex I Special Areas (10 Regions)

Mediterranean Sea, Baltic Sea, Black Sea, Red Sea, "Gulfs" Area, Gulf of Aden, North-West European Waters, Antarctic Area, Oman Sea of the Arabian Sea, Southern South African Waters.

Rule: Tanker cargo discharge totally prohibited. Bilge water permitted only if ≤15 ppm, en route, processed through 15 ppm filtering gear with automatic stop.

Annex V Special Areas (8 Regions)

Mediterranean Sea, Baltic Sea, Black Sea, Red Sea, "Gulfs" Area, North Sea, Antarctic Area, Wider Caribbean Region.

Rule: Comminuted food waste (≤25 mm) permitted only at ≥12 NM (instead of 3 NM). Discharge of all domestic garbage, incinerator ash, cargo dunnage, and wash water additives prohibited.

Annex VI Emission Control Areas (ECAs)

Baltic Sea (SOx/NOx), North Sea (SOx/NOx), North American ECA (SOx/NOx/PM), United States Caribbean Sea ECA (SOx/NOx/PM), Mediterranean Sea (SOx from May 2025).

Rule: Fuel sulphur cap drops from 0.50% to 0.10% m/m. Marine diesel engines installed on/after designated dates must meet Tier III NOx limits (typically requiring SCR or LNG).

4. Statutory Certificates & Port State Control (PSC) Verification

A ship cannot legally trade internationally without carrying valid statutory certificates issued by or on behalf of its Flag Administration (frequently delegated to Recognised Organisations like DNV, Lloyd's Register, or ABS). All MARPOL certificates are harmonised under the Harmonised System of Survey and Certification (HSSC) with a 5-year maximum lifespan.

Port State Control (PSC) officers conduct shipboard audits following standard procedures established by regional agreements (Paris MoU, Tokyo MoU, US Coast Guard). An inspection follows an escalating protocol:

Initial Document Examination: The inspector reviews certificates for validity, endorsements within the statutory ±3 month window, and matches them to official logs (Oil Record Book, Cargo Record Book, Garbage Record Book, Bunker Delivery Notes).

Visual Machinery & Hull Inspection: The inspector tours the engine spaces, steering flat, and deck, inspecting the physical integrity of the OWS piping, checking for unauthorized bypass lines ("magic pipes"), oil stains on bilge valves, and garbage station cleanliness.

Invocation of "Clear Grounds": If certificates are missing, logs show missing tank soundings, physical piping displays missing flanges or fresh paint over bypasses, or the crew cannot operate equipment, the officer establishes statutory clear grounds.

Expanded Technical Testing: The officer demands physical operational demonstrations: simulating high-concentration oily water to trigger the 15 ppm OWS alarm, testing the fail-safe 3-way diversion valve, checking sewage aeration blowers, and collecting fuel drip samples from the engine supply line.

Detention or Rectification Order: Deficiencies directly affecting seaworthiness or environmental safety (e.g. inoperable OWS, falsified Oil Record Book, defective incinerator) trigger an immediate Code 30 Detention Notice. The vessel is legally prohibited from sailing until rectified.
